By accessing or using EngageGPT ("the Service") at engagegpt.io, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Attempt to circumvent or interfere with the security or integrity of the Service
Use the Service to send spam, engage in phishing, or distribute malware
Scrape, reverse-engineer, or attempt to extract the source code or underlying data of the Service
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Use the Service in any way that could damage, disable, overburden, or impair its infrastructure
Attempt to gain unauthorized access to other users' accounts or data
We reserve the right to suspend or terminate access for any user who violates these rules, without prior notice.
Credits, Payments, and Refunds
The Service operates on a credit-based system. Credits can be purchased via the available payment methods and are used to fund campaigns and services. All purchases are final. We do not offer refunds except where required by applicable law or at our sole discretion in cases of technical failure attributable to EngageGPT. Credits have no cash value, are non-transferable outside of the platform's designated transfer features, and may not be exchanged for currency. We reserve the right to modify credit pricing at any time with reasonable notice.
Social Media Accounts and Third-Party Platforms
By connecting a social media account to the Service, you authorize EngageGPT to interact with that platform's API on your behalf, including retrieving analytics and executing campaign actions. You are solely responsible for ensuring that your use of the Service complies with the terms and policies of any connected third-party platform. EngageGPT is not affiliated with, endorsed by, or responsible for any third-party platform. We reserve the right to suspend campaign activity if we determine that it risks violating third-party platform policies.
Intellectual Property
All content, software, trademarks, logos, and materials made available through the Service are the property of EngageGPT or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent. You retain ownership of any content you upload or connect to the Service; by doing so, you grant us a limited license to use that content solely to operate and provide the Service.
Disclaimer of Warranties and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results from the use of the Service, including campaign performance or engagement outcomes. To the maximum extent permitted by applicable law, EngageGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to EngageGPT in the 30 days preceding the claim.
Governing Law and Contact
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts.
