Acceptance of Terms
By accessing or using EngageGPT at engagegpt.io, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including individuals and organizations. We reserve the right to update these Terms as described in Section 15; your continued use of the Service after changes take effect constitutes acceptance. Eligibility and Account Registration
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By registering, you confirm that the information you provide is accurate and up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@engagegpt.io if you suspect any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
The Service
EngageGPT is a self-service software platform that helps you distribute engagement to your social media posts through third-party providers, on a prepaid credit basis. EngageGPT is a software product, not a managed-services, agency or consulting engagement, and we provide no guaranteed results, service levels, or dedicated personnel unless separately agreed in writing. We may add, change, suspend or discontinue any part of the Service at any time, as described in Section 15.
Permitted Use and Prohibited Conduct
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
Use the Service to violate any applicable local, national, or international law or regulation;
Attempt to circumvent or interfere with the security or integrity of the Service;
Use the Service to send spam, engage in phishing, or distribute malware;
Scrape, reverse-engineer, or attempt to extract the source code or underlying data of the Service;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Use the Service in any way that could damage, disable, overburden, or impair its infrastructure;
Attempt to gain unauthorized access to other users' accounts or data.
We reserve the right to suspend or terminate access for any user who violates these rules, without prior notice.
Social Media Accounts and Third-Party Platforms
To use the Service, you provide the public link(s) to the post(s) you wish to amplify and/or identify the public profile to be monitored. Engagement is then delivered to those public posts by independent third-party providers.
We do not access your account. EngageGPT does not require, request, or store your social media login credentials, and does not log into, authenticate as, control, or publish from your social media account. We do not act on your behalf through any platform's authenticated interface. Post monitoring and analytics rely on publicly available information and third-party data services.
You are solely responsible for ensuring that your use of the Service complies with the terms and policies of any relevant third-party platform (including, without limitation, X/Twitter, Instagram, and Telegram). EngageGPT is not affiliated with, endorsed by, or responsible for any third-party platform. We reserve the right to suspend campaign activity if we determine that it risks violating third-party platform policies.
Assumption of risk. You acknowledge and agree that third-party platforms may, at their sole discretion, throttle, restrict, suspend, ban, or take other action against accounts or content in connection with engagement activity, and that such outcomes are outside our control. You assume all risk arising from your use of the Service in relation to third-party platforms, and EngageGPT shall not be liable for any such action, loss of reach, loss of an account, or related damage.
AI-Generated Content
Certain features of the Service may generate comments or other content using artificial intelligence. Such content is provided on an as-is basis and may be inaccurate, inappropriate for a given context, or otherwise unsuitable. You are solely responsible for reviewing, approving, and publishing any AI-generated content, and for ensuring it complies with applicable law and with the policies of the relevant platform.
Credits, Payments, and Refunds
The Service operates on a credit-based system. Credits can be purchased via the available payment methods and are used to fund campaigns and services. Unless otherwise stated at the time of purchase or agreed in writing, credits are valid for twelve (12) months from the date of activation, after which any unused balance may expire. Credits have no cash value, are non-transferable outside the platform's designated transfer features, and may not be exchanged for currency. We reserve the right to modify credit pricing at any time with reasonable notice.
Refunds. Except where required by mandatory applicable law, all purchases are final and non-refundable once credits have been activated. We may, at our sole discretion, issue refunds in cases of technical failure attributable to EngageGPT.
Consumers in the EU. If you purchase as a consumer in the European Union, you may have a statutory 14-day right of withdrawal for digital services. By purchasing credits and requesting their activation, you expressly request that we begin performance immediately and acknowledge that, to the extent performance has begun, your right of withdrawal may be lost. This paragraph does not apply to business customers.
Intellectual Property
All content, software, trademarks, logos, and materials made available through the Service are the property of EngageGPT or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent. You retain ownership of any content you upload or connect to the Service; by doing so, you grant us a limited license to use that content solely to operate and provide the Service.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results from the use of the Service, including campaign performance or engagement outcomes.
Limitation of Liability
To the maximum extent permitted by applicable law, EngageGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability to you for any and all claims arising out of or relating to the Service or these Terms shall not exceed the total amounts paid by you to EngageGPT in the twelve (12) months preceding the event giving rise to the claim.
Exceptions. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for death or personal injury caused by negligence.
Indemnification
You agree to indemnify, defend, and hold harmless EngageGPT and its owner, affiliates, and personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) any content or comments you upload, generate, approve, or publish through the Service; (c) your violation of these Terms or of any applicable law; (d) your violation of the terms, policies, or rights of any third-party platform or third party; and (e) any action taken by a third-party platform against your accounts or content in connection with your use of the Service.
Data Protection and Privacy
EngageGPT Technologies acts as data controller for personal data processed through the Service and processes such data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection law. To provide the Service, we process the account information, post links, and campaign settings you provide, together with publicly available metrics relating to the posts you choose to amplify. We do not collect or store your social media login credentials. Our processing of personal data is described in our Privacy Policy, available at [https://engagegpt.io/privacy-and-policy], which forms part of these Terms. Term and Termination
These Terms apply for as long as you use the Service. You may stop using the Service at any time. We may suspend or terminate your access, in whole or in part, with or without notice, if you breach these Terms, if required by law, or if continued provision poses a risk to the Service or to third parties. On termination: your right to use the Service ceases; unused credits may be forfeited to the extent permitted by law and except where the termination is due to our material fault; and the provisions that by their nature should survive (including Sections 8–12, 17, 18, and 19) shall survive.
Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, outages or changes of third-party platforms or providers, network or infrastructure failures, cyber-attacks, changes in law, or governmental action.
Changes to the Service and to these Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; material changes will take effect upon posting the updated Terms with a revised "Last updated" date (or upon any longer notice period required by law). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Assignment & Severability
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or to an affiliate or successor entity (including, without limitation, a future group company).
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be replaced by an enforceable provision that most closely reflects its intent.
Entire Agreement
These Terms, together with the applicable invoice or order and our Privacy Policy, constitute the entire agreement between you and EngageGPT regarding the Service and supersede any prior agreements or understandings on the subject.
